As I mentioned to Adam some time ago, I believe that under the Maryland Constitutions from 1776 forward, the Compacts of 1776 and 1958 are unconstitutional, as are all arbitrations subsequently that involve the compacts, including the Black Jenkins Award. Sovereignty cannot be alienated unless it is done so following the rules for amending the constitution. Under the Constitution of 1776 that meant submitting the compact to two successive legislatures with an intervening general election. The compact of 1958 needed to be submitted to referendum. At least one retired judge of the Court of Appeals thought this an interesting theory when I raised it at a seminar I gave at the Judicial Institute this fall.
