Contents of U.S. Supreme Court case file for Maryland v. West Virginia, Oct. Term 1911, Original No. 1, held by the National Archives in Washington, D.C. Doug Littlefield reviewed the case file for Maryland v. West Virginia, Oct. Term 1911, Original No. 1, at the National Archives in Washington, D.C. That case file is contained in Entry 26 of Record Group 267, Records of the U.S. Supreme Court, Original Jurisdiction Case Files, 1792-1989. The following materials in the case file are contained in a total of five hollinger boxes: Box 1 -- 1) "Separate Report of Commissioner W. McCulloh Brown, including protests and exceptions in respect to the Report of Commissioners Julius K. Monroe and Samuel S. Gannett" (This report contains many deeds and patents along the disputed Maryland-West Virginia boundary.) 2) Printed copies of the Supreme Court's decision and final decree. 3) An enormous map showing the boundary between Maryland and West Virginia as surveyed for the Supreme Court decree. 4) An envelope containing: "Report of the Commissioners appointed by the Supreme Court to Run, Locate and establish and mark the Boundary Line Between the States of Maryland and West Virginia, from the Potomac River to the Pennsylvania State Line" and "Supplemental Report of Julius K. Monroe and Samuel S. Gannett, Commissioners." 5) Various exhibits (which include land patents, deeds, and historical maps). 6) A copy of "Final Report of the Virginia Commissioners on the Maryland and Virginia Boundary to the Governor of Virginia" (1874) entered as an exhibit in Maryland v. West Virginia. This report contains printed copies of the Virginia Commissioners' correspondence during negotiations with Maryland over the boundary issue in the early 1870s. It also contains the journal of the joint commission of Maryland and Virginia that tried to settle the boundary issue in the early 1870s. 7) "Joint Commission with Virginia for Marking the Boundary Lines of the State under Acts of Assembly of Mary & May 1852 and March 1860 -- Correspondence." This booklet contains hand-written copies of correspondence regarding negotiations between Maryland and Virginia over the boundary during the 1850s and 1860s. 8) "Communication from the Governor of the State of Virginia, Relative to the Boundary Line between Maryland and Virginia," January 9, 1860. 9) Various historical maps showing Maryland and Virginia entered as exhibits in Maryland v. West Virginia. 10) "The Answer of the State of West Virginia to the Bill of Complaint of the State of Maryland filed against her in the Supreme Court of the United States" (typewritten). In this brief, West Virginia asserts that certain parts of the 1785 Compact applied to the entire Potomac, and West Virginia also claimed that "it has been well understood by the people of said states ever since said compact was made" that parts of the compact applied above tidewater (see pages 66-67). This brief also sets out the purposes of all the various exhibits contained in box 1. Littlefield copied this brief. Box 2 -- 11) "Report and Accompanying Documents of the Virginia Commissioners Appointed to Ascertain the Boundary Line between Maryland and Virginia" (1873). 12) An expandable file folder containing various motions and pleadings, most of which were procedural. But also included in this folder is Maryland's "Bill of Complaint," "Answer of the State of Maryland to the Cross Bill of the State of West Virginia," and "Cross Bill of the State of West Virginia." 13) A second expandable folder containing miscellaneous minor documents of little importance. 14) Index to the transcript of record. Box 3 -- Transcript, pp. 1-963. Box 4 -- Transcript, pp. 964-2007. Box 5 -- Transcript, pp. 2008-3490.
