Board of Public Welfare v. Myers
224 Md 246 (1960)

Bill of complaint filed on behalf of Robert Myers, a minor, and others in the Circuit Court of Baltimore City on 26 February 1960. Subpoenas to answer bill of complaint issued to various entities representing the State Board of Public Welfare 26 February-10 March 1960. Demurrer and answer of State Board of Public Welfare et al. to bill of complaint filed 19 March 1960. Motion for hearing filed on behalf of the plaintiff on 22 April 1960; petition and order to take testimony under 560th rule filed on the same date, 22 April 1960. Summons for witnesses on behalf of the defendants filed on 2 June 1960 and on behalf of the plaintiffs on 3 June 1960. Case argued in Baltimore City Circuit Court before Judge Charles E. Moylan on 6 June 1960. Opinion of the court issued by Judge Moylan on 1 July 1960, filed later on 6 July 1960. Declaratory decree filed on 6 July 1960 adjudge, ordered, declared and decreed that the defendants are “permanently enjoined and restrained from denying to the Plaintiff and other Negro youths, solely on account of race and color, commitment, admission and transfer to any Training School established, operated and maintained by the State of Maryland.”

Appeal to the Court of Appeals of Maryland filed on behalf of the State Board of Public Welfare on 7 July 1960. Petition to extend the time for transmitting record to the Court of Appeals filed by the State Board of Public Welfare on 29 July 1960; order granting extension filed on 29 July 1960. Testimony of 6 June filed on 2 August 1960; plaintiff’s exhibits 1-5 and defendant’s exhibit 1 filed on 3 August 1960. Appeal from the Circuit Court of Baltimore City filed on 8 August 1960. Petition by Maryland Petition Committee, Inc. to file brief amicus curiae granted on 14 December 1960. Decree modified, and as modified affirmed, costs to be paid by the appellants on 7 February 1961. Opinion filed in Court of Appeals by Judge Henderson on 7 February 1961. Mandate by Court of Appeals of Maryland issued on 9 March 1961, filed on 10 March 1961. Modified declaratory decree issued by Judge Moylan in Baltimore City Circuit Court on 11 May 1961.
